FAQ’s
 
I was in an automobile accident and my medical bills are in excess of $30,000.00. The person who hit the automobile I was in had coverage of only $20,000.00. Is there any other method by which I might recover my medical bills?
 
If you have underinsured coverage on your vehicle or the owner of the vehicle in which you were a passenger had underinsured coverage, it is possible that the underinsured carrier will pay your excess medical bills. In most cases, you or your attorney will have to work with the underinsured carrier in order that certain policy requirements are met in order to qualify.
 
I have children by my first marriage and no children by my current marriage. I want to leave everything to my children. Can I do this through my Will?
 
You may attempt to do this but it is possible your current spouse may receive part of your estate. I spouse may do what is called "renounce a will". By doing such, the spouse may receive one-third of your estate. The spouse may also receive a minimum $10,000.00 as a surviving spouse’s share from your estate even though you have left your estate to your children.

 What is the difference between a drivers license being suspended and being revoked?
 
A suspended drivers license generally results in a person’s right to drive being taken away for a set period of time and reinstated after that person have the period of time has expired and the person pays a fee to the Secretary of State. Revocation of a license results in the person’s right to drive being taken away and this will generally last until that person has reapplied to the Secretary of State for a license and paid the required fees. In either case and just because a person has his or her actual drivers license in his or her possession, that person should not drive until notification in writing is received from the Secretary of State.
 
We are selling our home ourselves. What costs can we expect?
 
As a seller, you can generally expect to pay the cost of having the abstract brought up to date and the feel for a title insurance commitment. You can also expect to pay the fee for the real estate transfer taxes and any filing fees associated with the filing of a release of any lien or mortgage attached to the property at the time of sale. Outstanding real estate taxes unless otherwise agreed, will be prorated.
 
My ex-spouse and I have a child together who is under the age of 18 and was injured in single vehicle automobile accident in a vehicle driven by my ex-spouse. Can I recover anything on behalf of my child?
 
In theses type of cases a guardianship proceeding is generally set up on behalf of the minor child by the parent not responsible for the accident. The child may then seek recovery for items including but not limited to past, present and future pain and suffering, medical bills to be incurred by the child after he or she reaches age 18. The non responsible parent may also seek recovery for the cost of medical care to the child that the child may incur prior to his or her 18th birthday.
